PURCHASING TERMS & CONDITIONS

ABOUT THESE TERMS & CONDITIONS:

In these Terms and Conditions "we" and "us" means Avian Vitality – Business Licence 98632317 and "you" and "your" means you the customer. The Terms and Conditions together with your order constitute the entire Contract between us and you for the supply of products and birds. No other Terms and Conditions will apply.
The Contract cannot be varied unless we agree to vary it in writing or by email prior to the event.
 
LEGAL CAPACITY TO TRANSACT:
If you are under the age eighteen (18) years you cannot place orders with Avian Vitality.
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Any orders placed and accepted by us will be deemed to be by persons over the age of eighteen (18) years.
Should Avian Vitality suffer any damage or other losses as a result of a transaction entered into by a minor, Avian Vitality reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Avian Vitality without parental approval, causing additional costs for bank charges, transport and return of goods.
All costs will be borne by the parents/ or guardians.
 
PLACING YOUR ORDER & PAYMENT METHODS:
You may place your order by selecting items on the website, adding to your cart, which includes the express postal service cost/ or courier charges (postage &handling). Postage items are sent via Australia Post or Courier.
 
CONDITION OF SALE: -
By placing an order on the website, you have entered onto a contract with Avian Vitality based on these Terms and Conditions. - Goods will be posted when transactions have cleared in the form of Paypal/ Cheque / Direct deposit or manual Eftpos over the phone.
Orders placed on a weekend or a public holiday will not begin payment processing until the next day of business. 
Goods are freighted or posted ( Monday – Friday), excluding New South Wales public holidays.
Avian Vitality reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion. 
 
FREIGHT ;
Avian Vitality is not responsible for poss or damaged good during post..  Customers are responsible for any loss or damage, by making purchase on these terms. 

PRICES & GST:
All prices quoted on this website are inclusive of GST except for items that are exempt from GST. Items that include GST, and the total GST paid will be clearly marked on the invoice. Avian Vitality always seeks to list products & birds with the most competitive up to date price lists. Avian Vitality reserves the right to change prices for products & birds displayed on the Avian Vitality website at any time.  Please note - Invoices can show on your bank statements as (Kirsty Forster and/or Yass Valley Bakery). 

REFUND POLICY:
Avian Vitality will only be responsible for goods that have been found to be faulty/ or not as described. Goods damaged in transit will be the sole responsibility of purchaser & Australia Post. Any orders returned to Avian Vitality shall be at the purchaser expense.
 
DELIVERY CHARGES:
Delivery charges are listed in the shopping cart when purchasing for goods matching the corresponding weight costs per express post parcel size (with tracking). Goods above or outside the weight prices set on the website, will be quoted by Avian Vitality at the purchasers agreement and will be final once payment has been received in full.
 
DELIVERY TIMES:
Orders will be shipped to you by Australia Post or by Courier, depending on location and quantities purchased. Australia Post - Prices stated on our website for Australia Post (Express Post Service – with tracking number), are Australia wide costs, including postage and handling.
If you cannot sign or are not available for delivery, Australia Post will deliver your parcel to your nearest post office, for collection. You will be notified by Australia Post for collection. Courier Service - With our nominated Courier Service we recommend that your nominated delivery address is one where someone is present.
 
Courier Service WILL NOT deliver to P.O Boxes, only to street addresses. Our courier cannot guarantee a specific delivery date or time.  Avian Vitality is not responsible for delays or delivery issues - this is between the purchaser and delivery service, aquired by purchaser.

Although every effort is made to ship your order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your product has not arrived after the estimated delivery time, please check the website of the shipping service (Australia Post/ Courier Service), and get an up to date parcel location on your item.  if you do not have an email address you will need to request a tracking number from Avian Vitality.
